Silly bills, silly bills, silly all the way….

Hi, Bill

Alam ko na mahilig magpapamasko mga Pinoy na paagahan, kaya na nga iyan ang pinili kong pamagat ng itong artikulo.

Namamasdan ko na may ila’t ilang mga senador at kongresista na mahilig naman mag-file ng mga batas na pawang walang katuturan maski man.  Minsan minu-munimuni ko kung anong dumaan sa kanilang isipan para magpa-file ng mga bills na nito na parang pag-tripan ng kanilang sarili.

Ani UP Vice President for Public Affairs Prospero de Vera,

“What’s the overall impact of that on country? What’s best bang for the buck for every peso spent on salaries of legislators and peso spent in maintaining the House and Senate what should that one peso mean? You’re talking about the precious time of Congress,” he said in an interview.

“If Congress was not doing anything at all or no major pending bills or issues they have to address, okay lang patulan maliliit na local issues but if they have FOI (Freedom of Information bill) not moving, RH (reproductive health) bill stuck in floor debates, a bill to increase sin taxes, crucially needed then you ask the question. kahit di labag sa batas mas gugustuhin pagtuunan pansin yung unahin muna nila yung panukalang batas at prublema na kailangan ng bayan kung natapos na iyan okay na patulan mas maliliit na issue”

Sinaad rin niya,

“Dapat maging aral itong pagkakataong ito para magbago pagtingin ng botante sa pinipiling mambabatas. Malapit na ulit elections sa Kongreso sa 2013. Tanong ko sa nagagalit sa anti-planking bill , ano gagawin niyo sa kanya pag siya bumalik at hihingi basbas sa 2013? Medyo bawas na karapatan niyo magreklamo kung siya ulit. That applies to all lawmakers. It requires public to scrutinize the performance of the House.”

  1. Anti-sex toy bill (House Bill 4509)
    Ipinalunsad nito ni Reps. Irwin Tieng & Michael Velarde ng Buhay party-list noong 5 June 2011.  Dito binabawalan ang pagpalabasang pagbebenta ng mga tinuturing mga “sex toys” o mga laruang ginagamit parang pamparaos o pangkatularan ang sex act katulad ng mga dildos o bolitas.

    Isinasaad rito na “a person can be criminally liable if he, being a wholesaler knowingly distributes, possesses with intent to distribute, or offers or agrees to distribute, for the purpose of resale or commercial distribution and retail of the same and knowingly produces or offers or agrees to produce the same…A device not otherwise obscene may be obscene under the measure if the distribution of the device, the offer to do so, or the possession with the intent to do so, or production, the offer or agreement to do so, is a commercial exploitation of erotica solely for the sake of their prurient appeal.”

  2. Anti-planking bill (House Bill 5316)
    Ipalunsad nito noong September 20, 2011 ni QC Representative Winston “Winnie” Castillo (how about a bill prohibiting males from using “feminine” nicknames?).  Nandito ang ilang sinasaad sa ipinapatupad ng bill:

    “SEC. 2. A universal Code of Student Conduct is hereby prescribed where planking as a form of redress of grievance be strictly prohibited and appropriate sanctions be applied for violations thereof.
    SEC. 3. Under this Act, planking is when a student or group of students lies face down in unusual locations especially in streets or other public places, keeping the hands along the body and the feet outstretched and especially where such act is meant as a form of redress of grievance against government”

    Doon isinasaad na maaring mabawian ang buhay mga batang gumagamit ng planking bilang isang paraan para ipahiwatig ang kinaiinisan nila laban sa establishment, pero sila mismo ang bahala kung ipapabuwis nila ang kanilang pangarap para sa ideals nila.

    Kaya mo ba i-preso ito?

  3. Anti-Angry Birds bill (House Bill 5379)
    Isa ring pakulo ni “Winnie” Castillo, ito naman ang pinatupad nang dakil sa karamihang mga binebentang kung anu’t ano na may itsura ng mga Angry Birds™  o pati mga kalaban nila mga berdeng baboy. Ani Castillo, “a stall shall have no more than two kinds of the said birds emblazoned on it’s items. Items under the scope of the bill, includes but is not limited to: cups, mugs, pens, crayons, stickers, underwear, t-shirts, lingerie, cellphone accessories, plush dolls, action figures, books, spoon & forks, plates, caps, children’s toys, pins, clothing accessories, hair accessories, pants, shorts, watches, flash drives, wrist straps, pillows, candies, and stationary items among others”

    Now THAT'S the way to replicate the Angry Birds experience

    Dinagdag pa, “violators to this law will be sentenced to 6 months solitary confinement to a special facility called ‘The Angry Birds™ Room’  inside the New Bilibid Prison” Sa totoo lang, muntik ako napalaglag sa katawanan nang binasa ko ang isinasaad ng bill na ito.  Hasn’t Rep. Castillo heard of Intellectual Property Rights law?  Let Interpol (and Angry Birds’ creators/developers) take care of those who keep ripping off the Angry Birds logo and the associated characters.

Masasabi rin man na ang pag-fa-file ng mga walang-kuwentang at walang-katuturang mga bills ay nagiging isang sintoma ng isang gobyernong takot humarap sa katotohanan.  Di lang naman ang Reproductive Health at Freedom  of Information, pati naman sa pagbubuwag ng 60/40 cap sa foreign ownership at pagluluwag ng red tape para magsitayo ng negosyo rito ng mga dayuhang investor.

Sa tingin ko, pati rin sa USA, di sila nahuhuli sa mga ila’t ilang mga batas na nakakataka.  Eh, sa kanila mismo minamana ang ating “demokrasya” daw.
